Trump: Court upholds closure of de minimis exemption loophole

President Donald J. Trump announced on August 13 that the U.S. Court of International Trade has upheld his administration's closure of the de minimis exemption, a trade policy loophole allowing foreign shipments under $800 to enter the U.S. duty-free and with minimal scrutiny. Trump called the ruling a "BIG WIN" in a post on X, emphasizing that the loophole had been exploited by tariff cheats, fentanyl traffickers, counterfeiters, and other criminals.

According to Trump, the de minimis exemption cost the U.S. an estimated $10.8 billion in lost tariff revenue in 2024 alone, and a significant share of narcotics and counterfeit seizures came through the channel. The court ruled that the President had the legal authority to rescind the privilege, which Trump hailed as a victory for American workers and law enforcement. "America is now SAFER, our Workers are better protected, and BILLIONS in TARIFF Revenue that used to slip through this loophole can instead help pay for our Great Military, Tax Relief, NO TAX ON TIPS, and NO TAX ON SOCIAL SECURITY," Trump wrote. The ruling marks a key win for Trump's America First trade and enforcement agenda.
