THE LAWSUIT THAT COULD KILL SOCIAL MEDIA🚫
$META is down 34% from its highs and i don't think enough people understand what's actually happening here
two separate juries in two different states just found meta liable for harming kids through addictive platform design. new mexico hit them with $375M. california found them 70% liable. zuckerberg had to testify himself. both in the same week
but the fines aren't what matters. what matters is how they won
there's a law called section 230 from 1996 that basically says if someone posts something on your platform you can't be sued for it. that law is the reason facebook youtube x reddit.. all of them exist at the scale they do. without it they'd be liable for every single post and comment. impossible to operate
these courts found a way around it. they're not suing over what users posted. they're suing over the product design itself. the argument is "you intentionally built addictive features that harmed children." section 230 covers content. it does NOT cover design choices
and new mexico's AG literally said he's building a legal template that "could be modeled elsewhere in the country and around the world." he's not trying to win one lawsuit. he's setting the standard
now pile on top of that meta guided $115-135 billion in AI capex for 2026. operating margins went from 48% to 41%. they doubled their long term debt to $58.7 billion. and they're laying off hundreds of people while spending record amounts on data centers. make it make sense
this is not just a $META problem either. if the design liability argument keeps winning in court it reprices every social media company. $SNAP $PINS $GOOGL anyone running algorithmic feeds to drive engagement. google was named in the california case too
the $375M fine is a rounding error for meta. the legal precedent is not
